. as of now no workers out there to run the trains. christie smith live at the lake merritt b.a.r.t. station. you got a look inside by accident this morning. right? >> reporter: yeah, good morning. riders tell us they got word last night there would be limited b.a.r.t. service this morning so a couple of them showed up about 4:15 thinking i'll be the first one to get on the train and get in to san francisco this morning. but what happened is that they tried all of the doors, they were locked except for one and they were able to go down to the lake merritt station assuming it would be open but it wasn't. there was no station agent here at all until a couple minutes ago and the ticket machines saying out of service. the fare gates were standing wide open so really, an odd situation out here this morning. b.a.r.t. of course put out an advisory saying they are attempting to staff these positions. apparently not yet here totally at lake merritt station. that should be coming soon. of course after six months of talks and two rail shutdowns both sides reach a tentative deal last night and b.a.r.t.

that chris christie the governor and a potential presidential candidate tried to block but lost. nbc news justice correspondent pete williams now joins us from the washington bureau with more on this. good evening. >> reporter: and good evening to you. the new jersey supreme court ruling and it's a unanimous one, is a big rebuff to governor christie who opposes same-sex marriage. this is the first state marriage ban to fall as the result of a u.s. supreme court ruling in june. that's when the justices struck down the defense of marriage act and said the federal government must grant full marriage benefits to same-sex couples in states where they're legally married. today's ruling says because new jersey allowed only civil unions, same-sex couples there were discriminated against because they could not get those federal marriage benefits. a spokesman for governor chris christie said he believe it is decision should be made by the voters, he has nonetheless instructed state officials to cooperate in carrying out the court order. the governor can try in the state supreme court again in janua

, and that person is chris christie. now, we did hear a little bit of criticism in newark about cory booker, a schoolteacher told us she believes he's a little, quote, overrated and a maul business owner told me that booker appears too interested in his own political career and not only real people on the ground. what you overwhelmingly hear in newark where a lot of people know cory booker, he's extremely popul popular. people are leaving cars running in the street to take pictures with him. he's a celebrity politician in that town. when you talk to the supporters, a smaller number of people are the typical tea party republican. they were against obamacare and for a lot of conservative social issues against abortion and same-sex marriage. >> the last days of the race, that was a bold move to go out there heart on your sleeve and say i'm all the way out here on the tea party. >> it puzzled a lot of people, too, because it pushed him further to the right in new jersey, which is a centrist type of state and blue state. so people were wondering why did he do that? during the debate he really po
